It really isn't a constitutional issue, its a contractual issue. They all had contracts when they went into this season, as well as a collective bargaining agreement. Those contracts, if they don't currently contain a specific provision requiring that the players stand for the national anthem will kill any effort by the league or owners to "force" the players to stand. Any judge worth his salt will look at the contracts, find that the players owe no contractual duty to stand and that in the absence of such a requirement the contracts are controlling and govern the employer=employee relationship. Since those contracts typically are multi-year contracts they will have a "zipper clause" - meaning the contracts can't be revised, added to, or renegotiated without the consent of both parties. The owners and league will have to address it during the next collective bargaining session. Whoever wrote the post above is an idiot and has never had an employment contract. However, the Players are always free to choose to stand. Bottom line is that if cops stop shooting black people we'll be better off.
