                  12. A municipal charter is the constitution of a city and effectively limits the legislative power of a city in the same manner the state constitution limits the power of the Legislature. See Gontz v. Cooper City, 228 So.2d 913 (Fla. 4th DCA 1970); City of Miami Beach v. Fleetwood Hotel, Inc., 261 So.2d 801 (Fla. 1972)(municipal charter, like state constitution, is the paramount governing instrument of a municipality).

Adherence to the City Charter is mandatory, not discretionary, and must be considered in its totality where a statutory or charter provision direct the manner in which a specific act is to be done, it precludes the act from being done in a different manner. Alsop v. Pierce, 19 So.2d 799, 802 (Fla. 1944).
                  14. The City Charter mandates, in terms of “will,” that the Commission act by “written resolution” and by “ordinance” in matters of a franchise. See Article III, Section 6 of City Charter ¶6 above.
                  15. South Miami United (“SMU”) is a youth soccer club that has operated a league at South Miami Park for approximately two and a half (21⁄2) years.
                  16. About three (3) years ago, the CITY decided to enter into an agreement with SMU to run the soccer program at CITY facilities. There was no bid or RFP process, but SMU was selected based upon favoritism.
                  17. Given the duration of the agreement, some three (3) years, the agreement with SMU is a de facto franchise within the purview of Article VI Section 5 of the Charter addressing franchises. Article VI Section 5 of City Charter, ¶6 above.

                      knew of the violations that existed by having the leaders of SMU run the soccer program and also sit on the CITY’s Parks and Recreation Board, but consistent with the improper act and omission that give rise to this action, City administration and elected officials willfully allowed the violation to exist.

At all material times, elected officials knew of the existence of the “Cone of Silence” applicable to the RFP and that the intent and purpose of the “Cone of Silence” are to protect the process, assuring a fair and impartial decision making, selecting the most beneficial proposal to the CITY, and preserving the public trust.
                      27. The “Cone of Silence” prevents manipulation or corruption of the RFP and prevents that an award of an RFP proposal is done arbitrarily, capriciously, pre-textually, or based on personal favoritism.
                      28. The “Cone of Silence,” Florida’s Sunshine Law, and the Code of Ethics are intended to maintain transparency and equality to avoid any circumvention or manipulation of the bid,

                          The city reserves the right to choose who they want to run the program. It's NOT JUST about money or highest bid. It has a lot to do with finding the MOST qualified group to do the job. They chose SMU for the job they have already proven they can do. The community has shown that they are in favor of SMU, we are all happy with the program. Yet still the waters continue to get mucked by sore loosers and cry babies. Their sole aim is to discredit what South Miami United has done for the city and for children of South Miami, Coral Gables, Pinecrest, Downtown, Kendall...etc. The Grey Ghost just point fingures and never look at the damage they continue to cause. Now what? What has the Grey Ghost program done for this community besides run their own 2 teams, which, Daddy coaches. What has Grey Ghost soccer brought to the table, except headaches and crying over the fact that were voted against? All of this and the kids still don't have a place to play. The Grey Ghost Daddy/Attourney crew keep making a mess of what has already been resolved. For what purpose? Why create such a stink? What are they REALLY after?

                          Per the previous threads, (I'm guessing) the reason why the cost is $185 is because the Grey Ghost keep on fighting for the park. Good for them, but it just keeps driving the price up higher for the community. Thanks Grey Ghosts, now I will need to pay increasingly more, because you won't accept the fact that you are not wanted by the City or the community. Thanks for thinking of the community, I see where your heart lies. It has nothing to do with youth soccer or the community. It lies with you, obviously, wanting to line your pockets.

                          Grey Ghosts: Do everybody a favor...Stop thinking of yourself and remember that there is an entire community that you are screwing with for sake of your own personal vendetta. Let the kids play soccer already. Remember the kids?

                          If the Grey Ghosts cry to the point that they get the park, I will NEVER allow my children to be coached or be part of an orgnazation that puts themselves before the kids. That is all the Grey Ghosts have proven to be good at, at this point. They sure haven't proven that they can run a better soccer program, that's for sure.
